Eligibility for the Retention Program for Foreign Mid-Level Skilled Workers
Applicable Individuals:
Migrant workers who have worked in Taiwan for at least six years and overseas Chinese or foreign students who have obtained an associate degree or higher in Taiwan, meeting the required salary or technical conditions, may apply to be retained as mid-level skilled workers through their employer.
Salary Requirements
- Industrial Sector:
- Monthly regular salary exceeding NT$33,000, or
- Annual total salary exceeding NT$500,000.
- For overseas Chinese or foreign students: Initial employment at NT$30,000, increasing to NT$33,000 upon renewal.
- Social Welfare Sector:
- Institutional caregivers: Monthly regular salary exceeding NT$29,000.
- Domestic caregivers: Monthly total salary exceeding NT$24,000.
Definitions:
Regular Salary: Monthly compensation paid to employees, including housing allowance, transportation allowance, meal allowance, utility fees, performance bonuses, and attendance bonuses, but excluding overtime pay.
Total Monthly Salary: The total amount paid by the employer each month, including regular salary (base salary, monthly allowances, etc.) and non-regular salary (annual bonuses, holiday bonuses, employee dividends, performance bonuses, and overtime pay).
Technical Requirements
- Industrial Sector or Other Designated Jobs:
- Must meet at least one qualification from the Ministry of Labor's compiled list of professional certifications, training courses, or practical skill assessments.
- Exemption: If the worker's regular salary exceeds NT$35,000, technical requirements do not apply.
- Caregiver Work:Must meet both of the following conditions:
- Pass a Taiwanese language proficiency test.
- Complete a 20-hour training program.
Eligible Sectors
- Industrial Sector: Manufacturing / Construction / Agriculture (limited to aquaculture and agrifood processing) / Offshore fishing
- Social Welfare Sector: Institutional caregivers / Domestic caregivers
- Other National Key Industries: As designated by the central competent authority.
Quota Calculation
To protect local employment, the quota for mid-level skilled workers per employer in the industrial sector:
- Must not exceed 25% of the allocated migrant worker ratio.
- The combined total of migrant workers, mid-level skilled workers, and professional foreign employees must not exceed 50% of the total workforce.
Required Documents
- Proof of foreign worker's technical qualifications (not required if the worker’s regular salary is over NT$35,000).
- Proof of domestic recruitment efforts.
- Application form.
- Proof of no labor law violations (issued by the local labor authority).
- Other documents as specified in Article 44 of the "Regulations on the Permission and Administration of the Employment of Foreign Workers."
